Vacation Rentals Policies - Posarelli Villas Terms and Condition.
GENERAL LETTING CONDITIONS

POSARELLI VILLAS GB LIMITED (hereafter referred to as “Posarelli”) whose registered office is at Wellington House - East Road CB1 1BH - Cambridge - United Kingdom (company number: 05906789) – act as a principal.
Posarellivillas Italia srl – Via Montegufoni 20 – 50025 Montespertoli (FI) (hereafter referred to as “Posarellivillas Italia”) is Posarelli on-site agent (tour operator) and customers support for Italy, Spain, Greece and Croatia.

1) BOOKINGS
Posarelli is authorised to act as a principal to contract bookings on behalf of the owners of the properties.
The minimum stay is one week, always from Saturday to Saturday but there are some properties where flexible arrival and departure dates are accepted. If so, the minimum stay can be less than a week. This information is mentioned on the unit price list.

2) PRICES
The booking prices are divided by season and are meant per unit per week from Saturday to Saturday (possible exceptions are mentioned on the property description) and/or per unit per night (if stays shorter than a week are allowed).
All extra charges (mentioned on the unit price list) are not included in the booking price and are to be paid directly to the owner of the property or to his/her representative on arrival at the property unless otherwise agreed in writing at the time of booking.
The prices are an integral part of these General Conditions. Agents or distributors are not authorised to vary the prices in any way.
2A) MINIMUM PRICE GUARANTEE
Posarelli guarantees that the prices published through its pages are the lowest available on the market. If the clients should find (for the same dates, at the same conditions, and for tariffs in Euros) a lower price with a competitor, the client will be entitled to a discount by Posarelli equal to the difference between the Euro prices released by Posarelli and the ones published by the competitor (Euro). Only exception are tariffs in other currencies than Euro.

3) HOW TO BOOK
All bookings must be made directly through Posarelli or agencies, which are authorised to act on behalf of Posarelli. These agencies can also accept payments from the client on behalf of Posarelli. In order to complete a booking, the client must fill in the booking form and accept these General Letting Conditions.
A deposit of 25% of the total price is due at the time the booking is confirmed. The balance is due no later than 60 days prior to arrival at the property. If the balance is not paid within this time limit, Posarelli reserves the right to cancel the booking. Full payment is required for bookings confirmed less than 60 days prior arrival.
Possible exceptions to above payment terms are mentioned under the property description.
Upon receipt of the balance, Posarelli will provide the client with a voucher together with the address and directions to the property and the instructions for gaining access to it.
Upon arrival the client must show the voucher to the owner of the property or to his/her representative before gaining admittance to the property. No other document will be accepted. The voucher is personal and valid only for the persons named on the booking form and it is non-transferable. The owner or his/her representative will refuse entrance to the property if the number of persons exceeds the number mentioned on the voucher. If there is any change in the total number of persons during the stay, Posarelli must be informed in advance, otherwise the owner or his/her representative can request the whole party to leave, in which case the client will have no entitlement to any refund of the paid price payment or associated charges.
All changes and special requests must be agreed in advance with Posarelli. Posarelli reserves the right to charge any costs imposed by property owners arising from any changes or special requests.

4) PAYMENT
Payments must be maid in cleared funds by bank transfer (SWIFT) or by credit card (VISA, MASTERCARD or AMERICAN EXPRESS).
For payments made by bank transfer the name of the client, the booking number and the property reference must be clearly specified. If these conditions are not met, the booking is not valid. Payments in other currencies than Euros (€) are not accepted.
Posarellivillas requires secure and traceable payments (no payments in cash, cryptocurrencies or similar are required to pay the booking amount). Only traceable credit cards payment or bank transfers to UK-based HBSC Bank are accepted.

5) ARRIVAL AND DEPARTURE
The client must arrive at the property between 17.00. and 20.00 (possible exceptions are mentioned on the property description and/or on the voucher). Any change to the arrival times must be advised to Posarelli during normal office hours (from Monday to Friday from 9.00 to 13.00 and from 14.00 to 18.00) prior to arrival and are subject to the approval of the property owner.
In case of unexpected late arrival, the client must advise Posarelli or the owner directly whose contact details are available in the voucher. Should the owner or his/her representative not to be able to accept a late arrival, all associated costs incurred by the client (including without limitation) hotels, restaurants, travel are to be borne by the client. Should the owner or his/her representative be obliged to wait for customers after the agreed time, he/she may request a late-arrival fee.
Upon arrival the client must produce to the owner or to his/her representative the voucher and passports of all members of the party in order to conform to the Italian Law. For a selection of properties it is possible to complete the check-in procedures online prior arrival. Only guests whose passports are registered are allowed to stay in the property. If there is any substitution of persons during the stay, the owner or his/her representative can request the whole party to leave, in which case the client will not be entitled to any reimbursement or compensation.
The clients must depart on Saturday between 8.00 and 10.00 (possible exceptions are mentioned on the property description), after returning the house keys and allow the owner or his/her representative to inspect the condition of the property.

6) REFUNDABLE SECURITY DEPOSIT
Upon arrival the client must pay a security deposit as guarantee for possible damages and/or extra charges which are not included in the booking price.
The deposit is to be paid in Euros (€) (cash payments unless otherwise indicated on the unit price list and/or on the voucher) as per the amount indicated on the voucher to the owner or his/her representative. The owner or his/her representative has the right to refuse admittance to the property if the deposit is not paid, in which case the client will not be entitled to any reimbursement or compensation. This deposit will be refunded on departure after deducting possible damages and/or extra charges not included in the booking price. In case of early departure, the owner will refund the deposit after inspecting the house and will forward it to clients after deducting any relevant charges not included in the booking price or any damage caused by the clients. If the amount of possible damages is higher than the security deposit, the client must pay the difference to the owner or his/her representative before departure.
Posarelli is not responsible for any disputes between the client and the owner concerning the security deposit.

7) CLEANING
Upon arrival the client will find the property in clean and tidy condition. At departure the client must pay to the owner or to his/her representative final cleaning charges unless it has been specified that these are included in the booking price. It is the client’s responsibility to ensure that the property is left in the same condition of cleanliness and repair as upon arrival. The costs incurred by the property owner resulting from any failure by the client to maintain the property will be deducted from the security deposit.
In addition, during his/her stay, the client must comply with local regulations in terms of differentiated waste collection.

8) HEATING AND AIR CONDITIONING
Heating and/or air-conditioning if provided are mentioned on the property description and pricing. Heating and air-conditioning costs must be paid on the spot to the owner of the property or to his/her representative and can be calculated depending on the use, in which case the property description will read "according to consumption".
In Italy the use of heating (period of use, temperature…) varies from region to region. Generally the use of heating is allowed in the period from Nov. 1st to March 30th 8 hours a day.
The possibility of using the heating outside this period and the cost of it must be agreed with the owner of the rented property. The properties without the flag referring to the heating are not provided with a heating system.

9) PETS
Domestic animals (cats and dogs) are allowed only in the properties showing the flag referring to domestic animals.
At the time a booking is confirmed the client must advise Posarelli of any domestic animal (indicating size and breed) and Posarelli will inform the owner of the property.
The property owner may request an extra charge for accepting a pet. If so, this supplement will be mentioned on the property description and must to be paid on site.
The customer must look after his/her pet in order to avoid possible damages and/or any disturbance to other guests.

10) BEHAVIOUR
The client renting a Posarelli property is responsible for his/her correct behaviour whilst occupying the property. Should a client fail to behave in a civilised and decent manner, the owner or his/her representative has the right to ask the whole party to leave the property immediately and may deduct from the security deposit such sums as are necessary to repair any damage and cover any related costs. In these circumstances the client will have no entitlement to any refund of the paid price or associated charges.
If the amount of possible damages is higher than the security deposit, customers must pay the difference to the owner or his/her representative before departure.
IMPORTANT
It is absolutely forbidden to access (for any reason) the rented property with a number of guests higher than the maximum property capacity without prior authorization of the owner. It is also strictly forbidden to organize parties, birthday parties or events in general without the approval of the owner.

11) EXTERNAL MAINTAINANCE
The owner or his/her representative reserves the right to enter the property for essential maintenance works (garden, swimming-pool, etc.) even in case of independent villas.

12) REFUND FOR CANCELLATION – PosarelliVillas For You
PosarelliVillas offers guests the opportunity to request a refund of up to 80%, even in cases not covered by the standard cancellation policy. This right to reimbursement applies in the event of exceptional and unforeseen circumstances that prevent the guest from proceeding with their stay — such as serious illness, an accident, or the sudden and involuntary loss of employment.
This cover is not limited to the individual directly affected. If included under the same booking, it also extends to immediate family members and one accompanying traveller. 13) COMPLAINTS
The description of the properties are made in good faith. Posarelli cannot be held responsible for changes carried out by the owner of the property without noticing Posarelli.
If the client has any complaint in the property, he/she must inform Posarelli (and/or the local partner Posarellivillas Italia) while at the rented property and confirm it in writing within 24 hours (Posarelli offices are open from Monday to Friday from 9.00 to 13.00 and from 14.00 to 18.00 – the local partner Posarellivillas Italia are also available from Easter to October on Saturdays on the following number: +39 0571675200).
Complaints will not be accepted unless this procedure is observed. Posarelli (or the local partner Posarellivillas Italia) reserves the right to verify, during the period of occupancy, the reasons of the complaint of the client, if necessary by inspecting the property. If the complaint is accepted, the client will be compensated in proportion to the extent of the sustained damage (up to a maximum of the booking price).
If necessary, Posarelli reserves the right to move the client to a similar or to a better property, subject to availability.
If the price of the alternative accommodation is higher than the price of the booked property, the difference will be not be charged to the client. Should the client accept this exchange, no further compensation will be payable to the client.
If no alternative property is available, Posarelli will refund the client. In no circumstances will Posarelli pay or be liable for any hotel or other accommodation costs.
If a client leaves a property without giving Posarelli or their representatives the possibility of verifying the reason of complaint, the client looses the right to any compensation or refund. If a client complains when he/she is no longer at the rented property, he/she looses the right to any compensation or refund.
Posarelli will not accept as causes for complaint weather conditions, stings or presence of insects, lack of water or electricity, work in progress, etc., if these depend on state-run organisations.
Posarelli properties are not hotels but private homes. Their equipment, furniture and characteristics reflect the local style, the taste of the owner and the Italian or local traditions (ex.: normally the coffee machine is the Italian espresso maker and not the electrical machine) and do not reflect the standard grading used by hotels. Therefore Posarelli will not consider these elements as a cause of complaint.

14) CANCELLATION
Should the client for any reason cancel the booking, the following cancellation charges will be applied (all cancellations must be confirmed in writing):
- 25% of the total price if the cancellation is made 60 days or more prior arrival day.
- 50% of the total price if it is made between 59 and 30 days prior arrival day.
- 90% of the total price if it is made between 29 and 1 day prior arrival day.
- 100% of the total price if it is made on the arrival day or in case of no-show.

Possible exceptions to above cancellation policy are mentioned under the property description.

For any amendment to the original booking, assuming that the property and the booking period remain the same, the client must pay a fee of € 50,00. If the property and the booking period do not remain the same, the booking has to be cancelled applying the above cancellation fees, and a new booking is necessary. Should Posarelli succeed in renting the property of the cancelled booking, the client must only pay a penalty equal to the actual damage sustained by Posarelli.
Should Posarelli be forced to cancel a booking because of reasons outside of their control, Posarelli will, subject to availability, offer a similar or a better property. If the price of the alternative accommodation is higher than the price of the booked house, the difference will not be charged to the client. In case no other alternative accommodation is available, Posarelli will refund the client and no further compensation will be due to the client.

15) JURISDICTION
Any dispute claim or other matter arising from any bookings and these general terms will be subject to the laws of England and the parties agree to the exclusive jurisdiction of the courts of England and Wales.

16) DATA PROTECTION
Posarelli, acting as a data controller, may use your personal data (as defined by the UK Data Protection Act 2018 as updated from time to time) for the purposes of processing bookings, client identity verification, the administration of files and records, legal and regulatory compliance, the marketing and promotion of its services, and to inform you of relevant news. In certain circumstances, your personal data may be transferred outside the UK and the European Economic Area (EEA, in which case, Posarelli seeks always to ensure that it is protected by standard contractual clauses or other mechanisms which facilitate the international transfer of data.
As part of the booking process and in order to perform our contract with you, Posarelli may share your personal data including your contact details and booking details and preferences with subsidiary companies, with property owners, property managers, and supplier partners such as travel agencies, IT and booking management platform providers. Property owners and managers act as independent data controllers of the information shared with them. We share your personal data with third parties only in order to facilitate your booking and all third parties are contractually bound to comply with applicable data protection laws.
You have the right to access, access, rectify, delete, object to, and update the personal data that Posarelli holds about you. To exercise any of these rights, and/or If you do not wish for Posarrelli to process your personal data for marketing purposes, please contact us at booking@posarellivillas.co.uk. You have the right to lodge a complaint at any time with the competent authority responsible for data protection issues. However, we advise you to contact us first so we can discuss and solve your privacy concerns.
Posarelli will retain personal data related to (i) transactional record for 7 years from the date of their creation, and (ii) communication and customer service records for up to 3 years, or otherwise for as long as necessary to fulfil the purposes for which it was collected, including to meet any legal obligations to which Posarelli is subject.
